Urbanisation Series: Impact of China’s Environmental Regulations on Foreign Business


The European Chamber is pleased to invite you to the next urbanisation series on environmental law, specifically the impact of China’s environmental regulations on foreign business.

The event is sponsored by Hogan Lovells and supported by DUSA, the Swedish Chamber of Commerce in China and AustCham Shanghai.

On 25th April, the Standing Committee of the National People’s Congress approved revisions of China’s Environmental Protection Law. The landmark revisions mark the first change to the law in 25 years, since it took effect in 1989. The law newly includes environmental data transparency and public participation, and places unlimited, stricter fines on environmental polluters. The amendments, effective on 1st January 2015, come after Premier Li Keqiang declared war on pollution at the opening of the National People’s Congress in March, and signify a pledge by the Chinese leadership to abandon a growth-at-all-cost economic model that has spoilt much of the country’s environment.

The diversity of speakers at today’s event will explore exactly how and to what extent China’s current environmental policies impact foreign business. It will also look at how the country’s environmental laws compare with international environmental standards and assess the capacity of China’s legal framework to properly address its environmental challenges.

Adam is a partner in Hogan Lovell’s environmental practice with more than 28 years of experience in all aspects of environmental regulation and litigation. Drawing upon his years of experience at the U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice, Adam counsels clients on each of the major environmental regulatory programs (air, water, waste, hazardous substances, pesticides and toxics). He also represents clients on a broad range of adversarial environmental enforcement matters, including major Federal civil judicial and administrative litigation under each of the major Federal environmental statutes. Adam has negotiated and resolved matters arising under the Clean Air Act, the Clean Water Act, the Oil Pollution Act of 1990, the Resource Conservation and Recovery Act, the Superfund statute, the Toxic Substances Control Act, and the Federal Insecticide Fungicide Rodenticide Act. He is particularly experienced in many aspects of the Clean Air Act, including the Clean Air Act’s New Source Review, air toxic, Title V, greenhouse gas, stratospheric and mobile source programs. Adam also has extensive experience under both the Clean Water Act’s discharge permitting and wetlands programs. Adam previously served as the Director of the EPA’s Air Enforcement Division and then the Director of EPA's Office of Civil Enforcement prior to joining Hogan Lovells. Before that, Adam was a Senior Counsel and trial attorney for more than 10 years in the Department of Justice’s Environmental Enforcement Section.

Huang Cheng graduated from the automobile department of Tongji University. He currently is the vice director of Atmospheric Environmental Institute of Shanghai Academy of Environmental Sciences. He has been working on air pollutant emission inventory and control studies for 10 years.

Today, with branches in Shanghai, Beijing, and Suzhou, PureLiving is China’s leading indoor environmental quality testing and consulting firm. PureLiving specializing in advising residential and corporate clients on air and water quality, mold, asbestos and lead exposure issues. PureLiving implements solutions for clean air including the design and installation of filtration and IAQ monitoring systems. Louie has over 20 years of scientific consulting experience as a chemical warfare engineer with the US Army, trained with the US CDC, and was formerly the Asia Strategy Director for Thomson Reuters’ Scientific Division. He has led or supervised over 1800 environmental and green building projects in China and the US. Louie is a member of the Indoor Air Quality Association, has trained with the US Centers for Disease Control, and is a graduate of Harvard College and Dartmouth Business School. Louie is a frequent public speaker for radio, television, CEIBS Business School, and industry associations including CoreNet and IFMA.

Thomas Shao has been the Senior Advisor of Public Policy for Evonik since 2012. Prior to it, he was the Vice President of Invest Shanghai after he worked as Assistant Director of Foreign Affairs Department and later Foreign Investment Promotion Department of Shanghai Municipal Commission Commerce. He acquired Bachelor's Degree of political science in China Foreign Affairs College in 2000 and Master's Degree of International Management in Queen Mary & Westfield College in 2007.
